The practice note includes content on the background to competition in the UK energy sector, the concurrent competition powers held by Ofgem and the Competition and Markets Authority (CMA), market structures and related competition issues, approach to market definition and competition investigations, market studies/investigations and mergers in the energy sector.

Updated SFO guidance on evaluation of compliance programmes
On November 26, 2025 the SFO published updated guidance on its evaluation of compliance programmes (the Guidance). The Guidance follows on from the updated Corporate Prosecution Guidance published in August (and which was covered in our recent horizon scan), the SFO corporate cooperation guidance published in April (see here), and the Home Office Guidance on reasonable procedures to prevent fraud.
