Fat Boy v. Mr. Hairpiece: The Ontario Court weighs in on conduct at discovery

Over the last twenty years, lawyers and law societies have lamented the lack of professionalism displayed by some lawyers during discoveries. The caselaw in the United States is replete with examples of “Rambo” lawyers not content to sit back while their witnesses are examined by opposing counsel. A classic example:

Attorney A: You don't run this deposition, you understand?
Attorney B: Neither do you, Joe.
Attorney A: You watch and see. You watch and see who does, big boy. And don't be telling other lawyers to shut up. This isn't your g - d - job, fat boy.
Attorney B: Well, that's not your job, Mr. Hairpiece.
