Biography
James Richmond is a construction lawyer practising primarily in our litigation and disputes group, representing clients in both the construction and infrastructure sectors.
James assists clients in managing and resolving claims and disputes through negotiation, mediation, arbitration and litigation. He has significant experience with complex construction matters involving contract and payment disputes, delay claims, liens, bond claims, deficiency/defective work disputes, negligence allegations, and third-party claims.
In addition to helping owners, general contractors and subcontractors navigate issues that arise during and after a project's execution, James has experience supporting clients in procurement pursuits, including reviewing and responding to requests for proposal and requests for tender, and negotiating construction contracts under various contracting models as well as professional service agreements. His construction experience spans both the public and private sphere for infrastructure and building projects.
Before joining us, James served as in-house litigation and contractual counsel for nearly five years with one of Canada’s largest general contractors, providing him with valuable insight into the industry’s unique challenges and business dynamics. He is dedicated to delivering precise, business-focused legal advice to clients, always striving to achieve practical and efficient solutions.

James has acted in the following matters:
- Advised on a complex arbitration matter involving a large infrastructure project in Ontario and received a successful award of $10 million.
- Advised in a dispute with a terminated subcontractor regarding various delays and defective works and successfully had the subcontractor's arbitration dismissed for delay with full costs awarded to the client.
- Acted as litigation counsel for a contractor on a sports recreation centre in British Columbia that involved navigating multiple subcontractor liens, dispute resolution processes, mediations, arbitrations, and civil claims in excess of $15 million.
- Represented a contractor in a $30 million payment dispute in Ontario with an owner and successfully settled at mediation.
- Successfully brought a Canadian International Trade Tribunal complaint that saw the award of a $90 million construction contract in the Maritimes to the client.
- Acted as litigation counsel for a contractor on a large highway interchange project in British Columbia and successfully defended and settled multiple third-party claims relating to property damage, nuisance, and personal injury.
- On design-build projects in Ontario and British Columbia, advised on the request for proposal process and documentation, negotiated the contract with the owner, and negotiated agreements with lead consultants.
- In Nova Scotia, acted for the contractor on a progressive design-build project by preparing RFIs during the request for proposal process, negotiating the phase 1 professional services agreement and the phase 2 design-build contract, as well as drafting the agreement with the lead consultant.
- Acted for a specialized subcontractor negotiating dozens of contracts on high-profile projects.
