Montreal advises Lloyds of London against the City, seeking the annulment of a zoning by-law

We are defending the interests of Lloyds of London, the insurer of the City of Côte Saint-Luc. In 2002, Immeubles Canadien Pacifique inc. instituted an action against the City, seeking the annulment of a zoning by-law adopted in 2001 which affected the properties of the Plaintiff. The Plaintiff alleges that the by-law adopted by the City is illegal as it constitutes an unreasonable or illegitimate use of the powers of the City. Should the Court find that the zoning by-law was not ultra vires of the powers of the City, the Plaintiff seeks indemnification of $32M for the value of its property and the revenues that would have been generated by the residential development contemplated on the properties.
