Acted as counsel to Scotiabank Asset Finance, in connection with the C$105m senior revolving credit facility in favour of KMC Mining Corporation and certain of its subsidiaries. The facility was agented by Scotiabank Asset Finance, as Administrative Agent and Lead Arranger. As part of the financing, KMC repaid its existing facility with The Bank of Nova Scotia. KMC is a privately owned Canadian company that began operations in southern Saskatchewan and Alberta in 1949. The company started as a contract road builder and expanded to include railroads, dams and other major earthworks over the company’s 60 plus year history. As Western Canada developed, KMC completed projects throughout Alberta, British Columbia, Saskatchewan, Yukon, and Northwest Territories.
