Biography
Adam is an Associate based in Cape Town who forms part of our Transport team.
He has experience in large and complex cross-jurisdictional litigation and arbitration in various fora, stemming from maritime and insurance disputes relating to demurrage, cargo, and casualty claims.
Adam has advised insurers, cargo interests, charterers, and shipowners on disputes spanning South Africa, England, France, Ecuador, Singapore, Australia, Moçambique, Nigeria, Cameroon, China, the Netherlands, and other jurisdictions.
He regularly advises on port and customs regulatory issues, and engages with Governmental authorities and regulatory bodies in relation to port operations and licences. He is often involved in the drafting and negotiation of corporate and commercial documents, including bespoke services and sales agreements as well as charterparties, and has experience in reviewing and revising marine insurance policies.
Adam has particular experience in the supply and distribution of petrochemical products.
In addition to his maritime experience, Adam has also worked in the firm’s Construction team. In this area, he has advised on the development and financing structures of various energy generation and downstream supply projects. His involvement in these projects includes transaction advisory and project documentation roles, as well as advising on commercial structures and regulatory issues. Adam has also had exposure to the preparation and interpretation of, and disputes arising from, construction contracts, including various popular standard form contracts.

- representing shipowners involved in a multi-million dollar claim which has spawned multiple ship arrests and proceedings in Singapore, Bangladesh, the US and South Africa.
- advising the Fuels Industry Association of South Africa on strategic and regulatory issues relating to petro-chemical infrastructure and investment worth tens of billions of rands in the Port of Durban and elsewhere.
- preparing bespoke multi-modal charterparties for the transport of complex mining equipment from Europe to a mining site in Africa.
- representing cargo interests in their multi-million dollar claim arising from the high-profile mv Smart casualty, which has also involved proceedings in England, Hong Kong, and South Africa.
- acting for the liability insurers of a coal terminal in defending a claim in excess of a million dollars following an explosion aboard a bulk carrier.
- representing an LNG import enterprise in challenging, before the Ports Regulator, decisions relating to the licencing and operations of small-scale LNG import.
- advising a major international petrochemical company on demurrage disputes arising from the carriage of petrochemical products.
- preparing multiple bespoke service level and sales agreements for a major petrochemical company.
- advising a major South African insurance company on revisions to its watercraft insurance policies.
- advising a major South African underwriting manager on various marine insurance policy defence matters.
