Montreal advised Brault & Martineau in a tax dispute regarding treatment of the Company's stock

Our Montreal office acted as lead counsel for Brault & Martineau, a leading furniture distributor, in a tax dispute before the Court of Quebec on the tax treatment of the Company’s stock option plan for income tax and payroll tax purposes. Norton Rose Fulbright was responsible for all aspects of the tax appeal, including extensive disclosure of evidence at the discovery stage.

On March 11, 2019 Norton Rose Fulbright was successful at trial. This is the first case in which a Court has ruled that donations of options can be made tax free.

The Government of Quebec has appealed to the Court of Appeal.
