Our Vancouver office successfully acted for the City of Vancouver in an appeal overturning an unprecedented judgment that recognized a private law duty of care imposed on municipal officials to act in a reasonable time. The Court of Appeal found that the regulatory scheme did not create the necessary proximity to justify recognizing a private law duty of care and policy reasons, in any event, justify negativing a prima facie duty of care.  Local governments are relieved since the judgment exposed them to indeterminate liability.
