Biography
Kimberly Jeffers practises commercial and corporate law, with a focus on the healthcare, life sciences, privacy, and cybersecurity sectors.
In the life sciences and healthcare sectors, Kimberly counsels pharmaceutical and life sciences companies and other organizations on regulatory issues. She drafts and negotiates agreements on behalf of public health institutions, researchers and life sciences companies. In addition, she advises on mergers and acquisitions in the health and life sciences sector. She also develops internal policies to ensure alignment with evolving legal and regulatory standards and industry best practices.
In the privacy and cybersecurity sector, Kimberly assists clients in preparing for and responding to data and privacy breaches and cybersecurity incidents. She also advises clients on regulatory compliance with regards to privacy matters.
In addition, Kimberly has assisted clients in navigating public procurement matters, including obtaining an authorization to contract delivered by the Autorité des marchés publics and advising on the application of Quebec's Act respecting contracting by public bodies. She has also provided advice on consumer protection law issues, inter-governmental contract requirements, and French language requirements. She has developed an interest in issues that arise from artificial intelligence.
Prior to joining us, Kimberly was a litigation lawyer at a New York law firm, where she represented banking institutions, telecommunications companies, pharmaceutical companies and airlines with civil and commercial disputes, arbitrations and governmental investigations in competition law and securities law. She also worked on high-yield bond offerings for a London-based law firm.

Cybersecurity
- Acts as “breach coach” and advises clients in managing cybersecurity incidents (e.g., ransomware, business email compromise, data theft).
- Drafts cybersecurity policies for clients.
- Advises companies on ways to improve their pre-incident cybersecurity posture.
Privacy:
- Drafts privacy and data protection policies for clients.
- Advises on the collection, use, disclosure and cross-border transfer of personal information or personal health information.
- Assists private clients in responding to requests for access to information.
Health sector and life sciences:
- Provides regulatory advice in the acquisition or financing of medical clinics, pharmacies, medical imaging laboratories, retirement homes, long term care, senior homes.
- Drafts and negotiates agreements on behalf of public health institutions, private healthcare or life sciences companies, and researchers (e.g., clinical trial agreements, distribution agreements, confidentiality agreements, services agreements, supply agreements, quality agreements, data transfer agreements, collaboration agreements, medical distribution agreements).
- Provides advice on drug pricing and supply, patient support programs, and compliance with the Act respecting prescription drug insurance as it relates to drug manufacturers, wholesalers and pharmacists.
- Advises on the professional codes of ethics for physicians, pharmacists and nurses (e.g., matters relating to professional independence, conflicts of interest, advertising, testimonials, compensation, selling of health products) and compliance with the standards of practice or guidelines issued by various professional colleges.
