Vancouver advised Western Forest Products on a compensation claim for timber harvesting rights

August 29, 2019

Client: Western Forest Products

Our Vancouver office advised Western Forest Products (“WFP”) in relation to its compensation claim for timber harvesting rights and assets taken when provincial lands were converted into treaty settlement lands.

The majority of First Nations in British Columbia have unsettled land claims that overlap with long-standing timber tenures, and the Province may take back tenures as part of the treaty settlement process. In 2016, we assisted WFP in negotiating a multi-million settlement from the Province for the partial extinguishment of one of WFP’s tenures. We continue to assist WFP with advancing its claim for further compensation from the Province for the value of the WFP roads and improvements on the now treaty lands.

The team was led by Daniel Bennett, Q.C. and included Thomas Moran and Sarah McCalla.
